Why CEC’s recommendation with regard to Navin Chawla must be accepted by Government

The current controversy surrounding Election Commissioner Shri Navin Chawla reminds me of a conversation I had had with Benazir Bhutto when she visited Delhi during the NDA regime. She had lunch with me that day and she shared with me a delicious dish of Sindhi curry, which my wife Kamala prepares excellently.

In the post lunch chat we had that day, I posed a question to Benazir: “How is it” I asked her, “that though both India’s as well as Pakistan’s political leadership had imbibed a similar political culture under British rule, India had managed its democracy with remarkable success but in Pakistan democracy had been a total failure.” Benazir’s reply was succinct: “I attribute your country’s success to two factors: firstly, your Army is apolitical; and secondly, your Election Commission is constitutionally independent of the Executive.”

Benazir had rightly identified the two guarantees for Indian democracy. For the first of these ― the Indian Army never nurturing political ambitions of any kind ― the credit goes entirely to our armed forces and those who have led it since independence, while credit for the Election Commission’s independence must be given to the Constituent Assembly.

There were, however, eminent participants in the Constituent Assembly debate on Art. 324, who wanted the Election Commission to be invested with even greater independence than given to it. These members did not approve of the fact that the Election Commission was to be appointed by the Central Government, and that the safeguards provided to the Commission were limited to its removal. Speaking on the occasion, Pandit Hriday Nath Kunzru said:

“ We are anxious, Sir, that the preparation of the election rolls and the conduct of elections should be entrusted to people who are free from political bias and whose impartiality can be relied upon in all circumstances. But, by leaving a great deal of power in the hands of the President we have given room for the exercise of political influence in the appointment of the Chief Election Commissioner and the other officers by the Central government. The Chief Election Commissioner will have to be appointed on the advice of the Prime Minister, and if the Prime Minister suggests the appointment of a party man, the President will have no option but to accept the Prime Minister’s nominee, however unsuitable he may be on public ground”.

In 2006, the then Chief Election Commissioner Shri B.B. Tandon, in a well-argued letter addressed to Rashtrapati Dr. A.P.J. Abdul Kalam, had pleaded with Government that just as in the case of the Central Vigilance Commission and the National Human Rights Commission, the appointments are made not by the Executive but by Committees in which the Speaker of the Lok Sabha and Leaders of Opposition in Parliament are also included, in case of the Election Commission also, a similar Committee should be authorized to do so. Shri Tandon concludes his letter to Dr. Kalam with the observation:

“This approach would not only be in keeping with the spirit and sentiment flowing from the debates in the Constituent Assembly but also further strengthen the faith of the people of our great democracy in the continued impartiality, neutrality and credibility of the Election Commission.”

In the context of the current controversy about Shri Navin Chawla, it would be educative to compare Art.124 dealing with the Supreme Court, with Art.324 laying down provisions relating to the Election Commission. Art.124 provides that neither the Chief Justice of India nor any other judge of the Supreme Court can be removed from his office except by a process of impeachment laid down by Parliament. In case of the Election Commission, however, this kind of protection is provided only to the Chief Election Commissioner, and not to the Election Commissioners. In case of the other Election Commissioners the Constitution says that they “shall not be removed from office except on the recommendation of the Chief Election Commissioner.”

On behalf of the BJP, Party General Secretary, Shri Arun Jaitley has rightly argued that the word ‘recommendation’ used in the second proviso of Article 324(3) must be construed as a binding recommendation. Jaitley has drawn attention to Article 217 of the Constitution relating to appointment of High Court Judges where the appointment is to be “after consultation with the Chief Justice”, the Chief Justice’s views has always been regarded binding.

The Party therefore, feels that the Chief Election Commissioner’s recommendation with regard to Shri Navin Chawla must be forthwith accepted by Government.

    This issue of ‘NAVIN CHAWLA’ is of utmost significance to “INDIAN DEMOCRACY”,The NON CONGRESS parties were strengthened only after Mr.T N Seshan,played his constitutional role at his best and actaull showed the ‘ROLE AND POWER’ of the CEC.While the ex CEC Mr.GILL who was famous for his fued with T N SESHAN, is a MINISTER in the present UPA government,it shows what CONGRESS is upto with CHAWLA,BJP should fight tooth and nail to oust CHAWLA,the succession of CHAWLA as CEC would be the end of a TRANSPARENT and IMPARTIAL CEC.

    I agree that Chawla should go. He should never have been appointed as an EC in the first place.

    An unrelated point i want to make here. I have been completely disillusioned with the BJP. I had always been a BJP supported and voter. I voted for the BJP (R Ashok) in the last Karnataka assembly elections. Now, I am not sure I would vote for the BJP in the coming lok sabha elections. Why? Mangalore. I don’t want to get into the debate about so-called “Pub culture”. What dismays me most that the state has ceded space to goondas. If the BJP-led government can enforce law and order in the face of a few goondas and extortionists, what hope can we have that it will protect us from terrorists? I won’t by the BJP’s excuse that the incident was a conspiracy by opposition parties. Then please expose the conspiracy and ensure that the stringent punishment is meted to the so-called conspirators. Also, the BJP led goverment in Karnataka has done absolutely nothing on the infrastructure front.

    what ever the bjp says or shows to the govt about the illegality of the naveen chawala,it is concluding that the cong wouldnot heed to the law of the land as it is afraid of losing the next elections and want that the next cec would be naveen chawla who would be utilised to rig the elections.why shout so.why not all the bjp mps resign en mass immediately and force the govt to declare the election immediately.the parliament should be halted. no legislative busines should be allowed to be conducted including the budget proposal by the nda mps.when a govt goes wrong or try to go wrong it is the duty of the oppn parties to set it right by virtue of strong protests in all the spheres including judiciary.why not the bjp take the issue to supreme court for clearing the clouds and fogs of constitutional ambiguity.

    Right from the time Mr Chawla was appointed as the EC, even Congress supporters were suprised since the proximity of Mr Chawla to the Congress party for the past 30 years is very well know. After watching the interesting debate between Mr Jaitley and Mr Singhvi on NDTV, I would like to make a suggestion: Would it be possible for Mr Jaitley/BJP to writed a detailed sequence of events from the appointment of Mr Chawla in May 2005 till date, and that be published in various National and Regional newspapers. I think citizens should be aware of the wrong-doings the Congress has been and is always upto. I am really worried about what will happen once the CEC retires in April 2009, when the Lok Sabha elections will be in full swing……

    Chavla sahab is having long relation with congress.He was the person who brought the polling after emergency.Her wife always reciee large amount of funds and charity from lots of congress ministers.

    If I may add one more thing:

    Shri. Navin Chawla has been a Congress Partisan since the days of the 1977 Emergency, and his recent antics have proved that he has not lost his touch.

    Keeping a Congress Partisan in line to be the next Chief Election Commissioner (who will conduct the 2009 Parliamentary Elections this April-May) is as prudent as appointing a Fox to guard the Chicken Coop (Poultry Farm).

    I sincerely hope the Indian Government and the Indian President, Smt.Pratibha Patil behaves fairly in maintaining the neutrality of the Election Commission and accepting the recommendation of the current CEC to dismiss Chawla.

    History will judge the fairness and honesty of the Indian Government and the Office of the Indian President. So, let the Powers-That-Be keep this in mind at this juncture….. Do they want to remembered throughout history as noble Harishchandras or as evil Shakunis?

    Indeed, the neutrality of Election Commission now can only be restored if Navin Chawla is shown the door. But, given the track record of this government and ingeneral Congress Party, I don’t have any hope.

    Congress didn’t ’send’ Navin Chawla to EC to be removed. He will have to ‘deliver’ to Congress.. 2009 elections will be his term to ‘return’ the favor. Prime Minister - as you have already said that is Weakest ever in our history - will not be in any mood or even authority to act correctly on it! Ma’am will call the shots..!!! And she knows whats the obstacles in her sons way to be come PM!!! She will make sure that Chawla remain.

    Your explanation on why Shri Nawin Chawla should be removed was intriguing,however it looks like the government is in no mood to oblige.I really hope that they change their stand and uphold the dignity of our Constitution

    PS - Just a small point Sir.Your welcome message on the site,is it written by your staff? Somehow,it does not have the spontaneity that we are used to in your speeches.Also,the message of ‘Change’ sounds a little cliched and after being overused by Obama, I don’t think it appeals so much to bloggers, who are saturated with Obama and his rhetoric :P

    Dear Mr Advani,
    i completely agree with you on the suggested appointment structure of EC members. There cannot be a better choice which is in consultation with Leader of Opposition and speaker, this way the EC members become truly impartial.

    For that matter even at present crisis Manamohan Singh has an easy option of following footsteps of Atal Bihari Bajpeyee. All he needs to do is to call an all party meet, present the facts before everyone and then decide on consensus.

    I already know that this is a wishful thinking and the utopia of having congress acting free of its inherent desires to establish unsaid monarchy is far fetched, but then this is all democracy is all about - freedom to dream :)

    EC Chawla sat on the letter of CEC for six months and did not reply. When CEC got the reply and did not find it suitable, he sent his letter to the President. This aspect is being ignored by a section of press and motive is being discovered behind CEC’s letter. This is wrong.

    Election Commission is a great institution and Shri Advani’s recommendations makes sense in the light of last CEC’s letter to Pres Kalam. Partisan politics should be avoided and an effective way out should be found to ensure Election Commission continue to work independently.

    About Why CEC recommendation is binding :-

    It is necessary to understand the relevance of article 217 in current context and why recommendation is adjudged as binding. Judiciary is supposed to be independent of Executive and hence, ignoring the recommendation of Chief justice is tantamount to subversion of judiciary by executive.
    In case of Election commission, Election commission is supposed to be independent of Executive. Hence, ignoring the recommendation of CEC tantamount to subversion of Election Commission.

The country is again gone to dogs (80s have returned back in full form) and the tactics to fight evil have to be different from what your partymen are doing. A DAY IS NOT FAR AWAY WHEN YOU CANNOT UNDERSTAND WHEN A VERY GOOD MEMBER OF YOUR PARTY IN A VERY COMFORTABLE SEAT LOST THE ELECTION.

    All the comments we have been reading both from Congress perspective (N Ram in the Hindu), BJP perspective and neutral are based on technical flaws of the constitution after permanent ECs were appointed in 2004. What is the ethical or moral ground for defending such a person? Shouldn’t this be taken between party leaders to arrive at a consensus? In every Indian’s view, it is good if such people are not holding high posts.

I still feel that we are spending a lot of time in unnecessary arguments and counter statement which lead us no where. My apolozies if I hurt any one with this statement. I dont say that we have put forth the loop poles in system, but we have to limit it to very small extent. I would like here from you, my favourite leader, what will be your policy both economic, defence and external affairs for the next 5 years. How are we going to face the global economic cricis.     I have an unbiased and non-political view about EC Navin Chawla. He should be removed at first place. Justice should not only be done but also to be seen. If the Chief EC has no faith on him how can a general voter will have it?
    Navin Chawla has shown his bias in previous elections but that was ignored by the Government. Now it is high time to remove him because Chief EC himself has recommended for him.

    On this particular episode of Mr. Chawla as a citizen i want put some questions.
    Why only the BJP is raising issue? means why not NDA or other opposition parties? why there is no consensus between oposition parties also?
    Because it shows that BJP is only party in this battle.
    Why BJP is not going once again to the supreme court for the issue?
    Why BJP or rather NDA can not come from resigning parlament and pose the election eariler as suggested in one of your comment?

    The absence of equality among the EC’s is a serious lacuna and must be corrected. It is quite logical to presume that the CEC is the first among equals. But this has not been accorded constitutional sanction since in the era of coalitions it is virtually impossible to obtain the two-third majority that this will require. Since all these processes are time-consuming, in order to meet the exigencies of the current situation, the president must extend the tenure of the current by a suitable time period till the next round of Lok Sabha Elections are completed.

    Congress has been destroying institutions since 2004. Primary worry being their comparable performance with BJP led regime. BJPs handling of the economy saw a boom in housing sector, manufacturing and what not. Quota system was abolished by BJP. A gas connection used to cost Rs 4000 before BJP regime and when BJP cam to power it was distributed for Rs 500. Telephone connection applied in 1989 was released in 1998. A common man could dream of a home thanks to low intrest rates in BJP regime. BJP handed over a robust India with robust economy to UPA and what is there now. empty coffers. Congress always used blackmarketting tool to fill the coffers of its partymen. Security of Nation is at its low with no clue as to what this Govt has to do. The only way for it to stick to power is the short cut to destroy the institution called EC

    Dear Mr Advani,
    I read about the CM’s meet to discuss the Lok Sabha polls. Why weren’t the BJP leaders from the non- BJP states invited as well. This election is very crucial and I hope the BJP are working on key issues to be raised. Already there is going to be a huge unemployment issue that can be raised in addition to the rate of growth witnessed in the past years.

    I really think that focusing only on the BJP ruled states will not be very helpful. By correcting the mistakes made in Rajasthan and Delhi, I am sure the BJP can win more seats in these States/ UTs as well. We really want the NDA in power so that development continues as it was during Atalji’s time. I take this opportunity to wish Atalji a speedy recovery!!

    In addition I would like to request the BJP to stay away from organisations like the Ram Sena who will do nothing but malign the BJP. The Congress is doing all possible to woo the youth and there shouldn’t be a reverse action from the BJP. The youth are a force to recon with in the coming election and moral policing not only in urban but rural areas will totally backfire. We are living in a Democracy and we have the right to live the way we want to, if our families’ do not have an issue on how “free” we as the youth are, why should any organisation or party be involved. Please make sure that in your BJP ruled states no untoward incidents take place on Valentines Day because this will only alienate the youth further. We have witnessed youth anger in both BJP and non- BJP ruled States in the past weeks over this very issue.

    your candid and stark views on latest CEC row is commendable and very rationale in all count.However,entire issue needs to be addressed in much more comprehensive way rather than leaving it to mere a political.As everbody knows that in Aprlil,Mr.Gopalaswami would retire and his deputy,Mr.Navin chawla will take over CEC chair.Now ,when things have become fully transparent that Mr. Naving chawala is acting at the behest of Inida’a premier political party and it would be more dangerous to allow such a person to lead such a highest constitutional authority of India.The open comment by Law minister leaves shows the partisanship and malafide intention of the incumbent goverment for the forthcoming LS pools.I would request you,sir, that massive pressure should be launched to prevent Mr. Chawla to occupy highest constitutional authority to satiate one political party’s vested interest.

    We should be proud of the independence our defense forces and election commission, which maintains the true spirit of democracy. But as citizens( including you and me) , do we enjoy a social security ? Does our government and the administrative system guarantee us the same? As tax payers are we in the same position of our counterparts in UK, US ,Canada Australia etc.

    As you correctly pointed out, the Constitution does allow the CEC to remove anyone from the Election Panel. It is an open and shut case. If the government believes that Gopalaswami has acted in bad faith, or vindictively towards Chawla, the former should be duly accused in a civil court. In the meanwhile, there is no excuse for suspending the executive powers of the Chief Election Commissioner. In fact, the Law Ministry has almost borne out the accusation made by Mr. Gopalaswami by publicly announcing, ahead of time, that Chawla would be installed as next Chief Election Commissioner.

Gopalaswamy has used his discretion in a wrong way..i sincerly doubt about the authenticity of print media..whether the UPA is controlling it also…UPA wants his person to be the next chief election commissioner of india as they did in case of our President Mrs. Pratibha Patil…I can only beseech you to take a firm stand on preventing the sanctity of these revered posts whatever steps you have to take..please “LET THE TRUTH PREVAIL”.

Had CONGRESS really been serious about cleaning the judiciary , it would have not shown its awkward and reluctant stand when SC asked parliament to impeach JUSTICE RAMASWAMY after finding charges against him to be true .

    PAST CONGRESS GOVTS INCLUDING THE PRESENT ONE have already succeeded in taming and subsequently exploiting autonomous bodies like CBI (which is also a tool for teaching political opponents a good lesson ) and IB like agencies busy taping phones of opposition leaders . Dictating terms were well evident in the way by which defence minister A K ANTONY handled the 3 SERVICE CHEIFS who were unwilling to accept the ill framed PAY REVISIONS for armed forces . Ironically the series of events after Mumbai attacks forced the government to dissolve the fury amongst armed forces . What could be more shameful that we need high magnitude Mumbai type attacks to give the foremost sacrificer their due privileges ( more precisly their rights ) .

    Supreme court has shown an unprecedented activism in recent years to safeguard the constitution on the issues in which it is not very clear (because our forefathers never expected that politics will see drastic changes forgetting GANDHIAN and NEHRUVIAN legacy ) . So shall we rate this non-bookish and unconventional activism a ” A CONSTITUTIONAL OVERREACH ” . In both cases of Jharkhand confidence motion and Bihar assembly dissolution NDA was the victim and UPA was the perpetrator , so elitist intelletuals like you must have a ” POLITICAL MOTIVE ” in the Supreme Court’s unprecedented judgements. ( was fear of CONTEMPT OF COURT the reason behind you not writing a sensational editorial denouncing the Supreme Court ).     The Govt of Karnataka should take the Ram Sena issue very seriouslyl. It is really terrible if nothing is done about this. There is a big move from the Congress to attract the youth and with all the wrong doings of parties like the Ram Sena, the youth will move away from BJP ( just cause most people feel there is a link).
    Today they are said to have targeted a CPM MLA’s daughter, and they are threatening to disrupt valentine Day celebrations…. Its only 3 months before the elections and please make sure the Karnataka Government maintains peace, law and order.

    There is a space for every one to serve the country and undoubtedly the best place for a someone who knows “how the Congress works” is to be in the centre of affairs of that party itself. As an enthusiastic supporter of subversion of democracy during emergency years, there no better place for him than to take a role in leading Congress party and the country itself, if the party so decides.

    Election Commission should remain above party politics. This has to be ensured by all the national parties, for their own good as well as for the wider interest of the democratic principles of the country. Any disruptive tactics played at this level will leave a greater damage to the body politic of the largest democracy in the world.

    Chief Election Commissioner’s recommendation for removal of an Election Commissioner should not be derided as “suo motto”, but accepted as a binding recommendation as argued by Shri Arun Jaitley.

    I have been a very consistent supporter of the BJP and Shri.Advani since over 2 1/2 decades.Shri.Vajpayee was a great PM for India.I keenly desire that the BJP comes back to power both at the centre as well as in M’tra & many other states.
    However,even one or two odd cases of corruption by some BJP MLAs like in one recent case in K’taka,which I am visiting, boil my blood.
    Corruption must be weeded out totally & rule of law must prevail regardless of political persons enjoying spoils of office.
    Total ruthlessness in such matters is of paramount importance & urgency.Examples have to be set.
    There is something to learn from waht president Obama said in his inaugural speech & I hope BJPN & it’s supremo too take few cues.As re:me,I shall & will be an ardent supporter of this party & wish it all the best.

    Only in 1993 the Office of Chief Election Commissioner became a multi-member body ( from a single person office) with decision by majority. Though the Supreme Court had accepted the development, I personally feel that the AUTHORITY OF THE CHIEF ELECTION COMMISSION was effectively ERODED. It was like having 3 Prime Ministers or 3 Chief Justices or 3 Chief Ministers in place of ONE !!!!!

    I am sure when Advani ji becomes the next Prime Minister of India, we will surely electoral reforms at the TOP first in office of the chief election commissioner itself.

    It is a fact that the Present Election Commissioner has recommended BASED ON FACTS which are hard to ignore and he seem to have acted AS PER HIS CONSCIENCE which is good for India. The affected person has all the right to defend himself on impeachment proceedings which will have to hear him out before deciding. To say that the very recommendation is wrong is HEIGHT OF IDIOCY.

    There are two very different aspects of CEC’s report. One is, as you’ve pointed out, it being binding on the govt. The second and the more important one is the matter contained in the report itself. In my opinion, these are two very different things and should be delinked from each other. I agree that the recommendations flow out of the report itself. That’s fine but for the sake of implementation they need to be delinked. I’ll further amplify on this.
    Please consider, if you ask for an impartial inquiry on this issue (maybe by the Chief Justice) won’t the govt be compelled to do this? After all there have to be some very solid reason for the CEC to write a 90 page report in which he has cited 12 different instances where Mr Chawla’s actions have been inappropriate. Also, BJP may also ask for the report to be made public (there’s nothing secret in the report, I’m sure). Even if the govt doesn’t I’ll suggest the BJP ask for a copy under RTI or file a PIL.

    Now, I admit that asking for an inquiry would be like accepting the fact that the recommendations of the CEC are not binding. I also admit that it would be a climb down from your party’s position. That, Sir, would be a small price to pay if the overall aim is kept sight of. Also, if I may, this should’ve been considered by the party before they made their stand public.
    There’s another alternative for the party. File a case on these lines in the Supreme Court. Ask for both these things. Ask for removal of Mr Chawla and also for an inquiry into his conduct so that he can be punished as per the law. Let Supreme Court decide. In all probability it will order an inquiry which will eventually lead to the removal of Mr Chawla and resultantly, some kind of punishment as well.

    1) Mr. Navin Chawla has been in the Election Commision since 2005. After that several elections have taken place in many of which BJP has won. Does not this imply that the Election Commision does not the power to manipulate the polls at all?     2) I personally believe that the BJP instead of gunning for Chawla should have demanded the resignation of both CHawla and Gopalaswamy for the sake of the Commission. It would have shielded the BJP from Congress counter offensive and might have brought this crises to a meaningful resoultion.
    3) If the BJP does come to power, will your Govt. implement reforms in the commsion?

    The EC must be a neutral body, not filled by partisans. EC Chawla did not reply to the letter of CEC for six months and when he got the reply and did not find it suitable, he sent his letter to the President. This aspect is being ignored by a section of press and motive is being discovered behind CEC’s letter.
    The open comment by Law minister in favour of Navin Chawla shows the partisanship and malafide intention of the incumbent Government for the forthcoming LS polls.
    Since acts of Navin Chawla are not independent and free from Political Bias his impartiality cannot be relied upon. Mr. Navin Chawla is acting at the behest of his favorite political party and it would be more dangerous to allow such a person to lead such a highest constitutional authority of India. Hence CEC’s move to oust Chawla is right.

    i dont agree with your view that the CEC recomendations are binding on the president.while making constitution ,constitution makers clearly needed to create a election comission independent from the Excutive. to protect the independence of the election comission the CEC has been made to removed on the same ground as that of judge of supreme court. but they wanted to protect other election comissioners from Executive through the office of CEC. this is why CEC recomendations were made binding on the president.this should be read when the recomendations of council of minister are different from that of CEC ,the president should accept the CEC recomendation.itmeans the CEC recomendation are binding only when president make reference to CEC this is to say CEC dosnot enjoy suo motto powers to intiate the removal process of other election comissioner.

    The matter regarding Navin Chawla and Election commission has actually been misquoted and deliberately presented in diffrent context by a section of polity and media of our nation. Actually they have two important points in this regard: 1. time of recommendation by the CEC & 2. suo-moto power of the CEC Let us examine both these issues from the constitution of India and article 324(5); wherein interpretation is I think in favour of present reccommendatin of the CEC.Regarding time of recommendation, the opposition is actually to divert the mind of people making noise..We must think that what should be our main emphasis in this regard…you have rightly written in yr blog that Election Commission has been one of the strongest pillers of our democracy.     Tax Payers money should not be spent on Temples, muts, maszids, Churches and relegious rituals. When the country is lacking in Health ad education facilities and infrastructure facilities like proper roads How can we spend tax payers money on building temples and celeberating birthdays of swamijees. Ministers should not attend such functions and waste public fund.     I’m very sad that Mr Chawla has been appointed as CEC effective April. Had it been Mr Abdul Kalam as President, he would have had a re-look at the Government’s recommendation about this appointment.
    Also I was sad to read report in TOI about MPs’ attendance, participation in Question & Answer session in Parliament. Also very few BJP MPs figure in best 5 list. Hope this will improve in next session. Hope you will have a guideline given to your MPs on this.

Response of government and Congress was not surprising and can be very much anticipated. But what surprised me the response of our Media. Media acted actually in favour of Mr. Chawla by not questioning and high-lighting his biased act but indirectly supported Congress and Chawla by attacking current CEC and also putting BJP actions in questions.

    Does all this concerns you and force to think you that our country needs an un-biased media who does not act on some ones behalf or does not oppose one party’s ideology (who is representative of millions of Indians). This later charge also says that our media has its own political ideology which I believe is not good for our democracy.

    Also I feel if you have got such hostile media, BJP needs a media policy, plans and really excellent speakers.
